Refund Policy of Gym Direct (GD Wellness Pty Ltd)

This Refund Policy ("Policy") applies to the following purchases: purchases made through https://gymdirect.com.au as well as purchases made over the phone/in-store at Gym Direct located at 23–25 Mangrove Ln, Taren Point NSW 2229.

Orders placed on eBay and/or Amazon are an exception to this policy and are not included under Gym Direct’s Refund Policy.

 

1. GENERAL

1.1. We offer refunds, repairs and replacements in accordance with the Australian Consumer Law and on the terms set out in this Refund Policy ("Policy").


1.2. Any benefits set out in this Policy may apply in addition to consumer rights under the Australian Consumer Law.


1.3. Before making a purchase, please read this Policy so that you can understand your rights and what you can expect from us if a product or service you receive is faulty.

 

2. AUSTRALIAN CONSUMER LAW

2.1. Under the Australian Consumer Law:

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

2.2. We offer refunds, repairs, and replacements in accordance with the Australian Consumer Law.


2.3. The Australian Consumer Law provides a set of Consumer Guarantees that protect consumers when they buy products and services.


2.4. If the Australian Consumer Law applies, then we cannot avoid the Consumer Guarantees that it provides. If there is an inconsistency between this Policy and the Australian Consumer Law, the Australian Consumer Law will prevail.


2.5. Further information about the Australian Consumer Law and these Consumer Guarantees is available from the website of the Australian Competition and Consumer Commission.


2.6. If a product or service you purchased from us has a major failure (as defined in the Australian Consumer Law), then you may be entitled to a replacement or refund. You may also be entitled to compensation for any reasonably foreseeable loss or damage resulting from that major failure.


2.7. If a product or service you purchased has a failure that does not amount to a major failure, you may still be entitled to have the goods repaired or replaced.


3. CANCELLATION AND RETURN POLICY

3.1. Cancellations Prior to Dispatch

Cancellations are not accepted once an order is placed.
Our fulfilment and processing systems are immediate. Please ensure all details are correct before placing your order.

Made-to-order and custom items are final sale and cannot be cancelled, modified, or refunded.

3.2. Returns After Delivery (Faulty, Damaged or Incorrect Items Only)

If the item you receive is faulty, damaged in transit, or not as ordered, you may request a return within 14 days of receiving the item(s).

Requests will be assessed and may be approved by Gym Direct under the following conditions:

  • You notify Gym Direct within 14 days of delivery
  • A Return Authorisation is issued before returning any items
  • Services have not been performed, booked or arranged
  • The product is:
    • Not a pre-order, custom, or made-to-order item
    • Not purchased with or linked to installation services
    • Not purchased during sale/promotion, clearance, or ex-demo
    • Not used, assembled, installed, or altered
    • Returned in original packaging, with all components and manuals
    • In resalable condition
    • Accompanied by valid proof of purchase (bank statements excluded)
    • Returned by the original purchaser with proof of identity

All returns must pass inspection and approval by Gym Direct prior to refund.

3.3. Return Costs and Restocking Fee

  • Return shipping is at the customer’s expense
  • Gym Direct is not liable for lost or damaged returns
  • The use of a tracked courier service is strongly recommended
  • If the original order included free shipping, the actual shipping cost will be deducted from your refund
  • A 15% restocking fee applies to approved in-stock and pre-order returns
    • This may be adjusted based on packaging, product condition, or completeness
  • Refunds apply to the product purchase price only

3.4. Exclusions

Returns or refunds are not accepted under the following conditions:

  • The product has been used, installed, damaged, or altered
  • Custom or made-to-order product
  • Linked to or bundled with installation services
  • Product purchased under any promotion, clearance, ex-demo, or discontinued sale
  • The product returned without the original packaging or missing components
  • No Return Authorisation granted
  • Subjective dissatisfaction or change of mind

 

4. PRODUCTS DAMAGED DURING DELIVERY

4.1. Contact us immediately if an item arrives damaged.


4.2. You must supply a photo or video of the damage within 7 days of delivery, along with delivery documentation.


4.3. If approved, we will organise repair, replacement, or refund — provided the item is returned in the condition received, including packaging.

 

5. EXCEPTIONS

5.1. Refunds/replacements may be refused if:

  • The product was misused or damaged by the customer
  • The customer was made aware of defects at purchase (e.g., clearance, demo)
  • Service was requested against Gym Direct's advice
  • Installation/delivery services were arranged
  • Other exceptions as defined under the Australian Consumer Law

5.2. Gift cards and bundled bonus items must be returned. If not, their value will be deducted from the refund.

 

6. SHIPPING COSTS FOR RETURNS

6.1. If the return is covered by Australian Consumer Law, Gym Direct will cover the return shipping.


6.2. If not, you must cover return costs.


6.3. If the item is too large to return and is approved for refund or replacement, we may arrange pickup at our cost.


6.4. If the item is found not eligible after inspection, you will bear all shipping and assessment costs.

 

7. RESPONSE TIME

7.1. We aim to process all return, repair, or refund requests within 7–14 business days of return enquiry.

 

8. HOW TO RETURN PRODUCTS

8.1. Contact us using the details below to request a return.


8.2. Refunds will be made to the original payment method.


8.3. You must provide proof of purchase.


8.4. ID may be required to process returns


8.5. If returning under Section 3, ensure all outlined conditions are met.
